Open Letter to all Federal Firearms Licensees – Forced Reset Triggers

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) recently examined devices commonly known as “forced reset triggers” (FRTs) and has determined that some of them are “firearms” and “machineguns” as defined in the National Firearms Act (NFA), and “machineguns” as defined in the Gun Control Act (GCA).

These particular FRTs are being marketed as replacement triggers for AR-type firearms. Unlike traditional triggers and binary triggers (sometimes referred to generally as “FRTs”), the subject FRTs do not require shooters to pull and then subsequently release the trigger to fire a second shot. Instead, these FRTs utilize the firing cycle to eliminate the need for the shooter to release the trigger before a second shot is fired. By contrast, some after-market triggers have similar components but also incorporate a disconnector or similar feature to ensure that the trigger must be released before a second shot may be fired and may not be machineguns.

Both the NFA and GCA regulate machineguns. “Machinegun” is defined under 26 U.S.C. § 5845(b) and 18 U.S.C. § 921(a)(23) as—

Any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot, without manual reloading, by a single function of the trigger. The term shall also include the frame or receiver of any such weapon, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machinegun, and any combination of parts from which a machinegun can be assembled if such parts are in the possession or under the control of a person. (Emphasis added.)

ATF’s examination found that some FRT devices allow a firearm to automatically expel more than one shot with a single, continuous pull of the trigger. For this reason, ATF has concluded that FRTs that function in this way are a combination of parts designed and intended for use in converting a weapon into a machinegun, and hence, ATF has classified these devices as a “machinegun” as defined by the NFA and GCA.

Accordingly, ATF’s position is that any FRT that allows a firearm to automatically expel more than one shot with a single, continuous pull of the trigger is a “machinegun”, and is accordingly subject to the GCA prohibitions regarding the possession, transfer, and transport of machineguns under 18 U.S.C. §§ 922(o) and 922(a)(4). They are also subject to registration, transfer, taxation, and possession restrictions under the NFA. See 26 U.S.C. §§ 5841, 5861; 27 CFR 479.101.

Under 26 U.S.C. § 5871, any person who violates or fails to comply with the provisions of the NFA may be fined up to $10,000 per violation and is subject to imprisonment for a term of up to ten years. Further, pursuant to 26 U.S.C. § 5872, any machinegun possessed or transferred in violation of the NFA is subject to seizure and forfeiture. Under 18 U.S.C. § 924(a)(2), any person who violates § 922(o) may be sent to prison for up to 10 years and fined up to $250,000 per person or $500,000 per organization.

Based on ATF’s determination that the FRTs that function as described above are “machineguns” under the NFA and GCA, ATF intends to take appropriate remedial action with respect to sellers and possessors of these devices. Current possessors of these devices are encouraged to contact ATF for further guidance on how they may divest possession. If you are uncertain whether the device you possess is a machinegun as defined by the GCA and NFA, please contact your local ATF Field Office. We Have An FFL

Many of you may remember that we rented space to The Gun Vault in 2019 to sell firearms and do firearm transfers at the range. That went fine for a while, then the Big C19 hit, and everything firearms-related went down the crapper. Firearms and ammunition became scarce. What could be found was stupidly expensive. Almost a year into the Big C19 debacle we had to close for 8 months for some range renovations that turned into a nightmare.

After we reopened we had a lot of people asking when we’d have guns to sell again. So, after we got solidly back into the swing of things as far as range operations go, we applied for our FFL (Federal Firearms License) to be able to sell firearms. We decided to go with an 07 type, or Manufacturer FFL) which allows us to do firearm sales as well as create custom builds for our customers.

We do have limited space, so for the time being, our stock will be limited to the most popular models, but if you find something online we don’t carry, we will be happy to receive the transfer for you!

It’s been eight long months, but we’re FINALLY reopening THIS THURSDAY, July 1st! You will notice a few changes & a few new faces when you visit.

One change is we are now doing our liability waivers electronically. NO MORE PAPER! EVERYONE will need to do a new electronic waiver & you can do them RIGHT ON YOUR PHONE before you even get to the range!

As a reminder, all memberships that were valid the last day we were open in November will be extended 8 months. Gift certificates that would have expired while we were closed will also be honored for 8 months past the expiration date.

Ammo prices are still crazy, but we have quite a few calibers available, including 9mm, 40, 45, & 223. We will do a social media post with the list of the calibers we will have in stock on the 1st. I know we DO NOT have any 380 (sorry).

COVID-19 and Range Operations April 6 Update

openGovernor McMaster issued another Executive Order today. This latest executive order is entitled the “Stay at Home or Work” order. After reading through the order, shooting ranges, and firearms and ammo dealers are still considered essential, and as such, we plan to remain open our regular hours to continue to allow you to train with your firearms and exercise the natural rights reaffirmed by the 2nd Amendment.

We began limiting the occupancy of the retail and check-in area to 4 customers last week as well as cut our pistol range capacity in half, and we will be continuing those limitations. We will be evaluating the capacity of the rifle bay and that may be reduced as well.

You can read the entire executive order at this link. Here are some relevant excerpts as they apply to us. [Emphasis is ours.]

Section 1. Home or Work Order

B. I hereby order and direct that effective Tuesday, April 7, 2020, at 5:00 p.m., any and all residents and visitors of the State of South Carolina are required to limit social interaction, practice “social distancing” in accordance with CDC guidance, and take every possible precaution to avoid potential exposure to, and to slow the spread of, COVID-19, and shall limit their movements outside of their home, place of residence, or current place of abode (collectively, “Residence”), except as allowed by this Order, for purposes of engaging in Essential Business, Essential Activities, or Critical Infrastructure Operations, as set forth below and as such terms are further defined herein.

E. For purposes of this Order, Essential Activities shall mean and include as follows:

2. Obtaining necessary supplies and services for family or household members, such as food and supplies for household consumption and use, medical supplies or medication, supplies and equipment needed to work from home, and products needed to maintain safety, sanitation, and essential maintenance of the home or residence. Preference should be given to online ordering, home delivery, and curbside pick-up and delivery options and services wherever possible as opposed to in-store shopping.

3. Engaging in activities essential for the health and safety of family or household members, such as seeking medical, behavioral health, or emergency services.

F. For purposes of this Order, Critical Infrastructure Operations shall mean and include as follows:

1. Individuals operating commercial vehicles transporting essential goods and products, such as food, water, medicine, medical supplies and equipment, fuels and petroleum products (to include fuel oil, diesel oil, gasoline, kerosene, propane, and liquid petroleum), livestock, poultry, feed for livestock and poultry, and crops and other agricultural products ready to be harvested (to include timber and wood chips); individuals employed by airlines; and individuals otherwise engaged in commercial transportation activities.
2. Individuals performing or assisting with military, healthcare, public safety, or emergency response operations, as well as any other operations or services identified by the United States Cybersecurity and Infrastructure Security Agency in its March 28, 2020 Memorandum, or any future amendments or supplements thereto, as essential to continued critical infrastructure viability. [Firearm or ammunition product manufacturers, retailers, importers, distributors, and shooting ranges are listed as essential critical infrastructure in the March 28th memo, which can be viewed here.]

I. … 1. Emergency Maximum Occupancy Rate. The business shall limit the number of customers allowed to enter and simultaneously occupy the premises so as not to exceed five (5) customers per 1,000 square feet of retail space, or twenty percent (20%) of the occupancy limit as determined by the fire marshal, whichever is less.

J. This Section shall not be interpreted, applied, implemented, or construed in a manner so as to suspend, restrict, or otherwise limit the sale or transportation of firearms or ammunition or any component thereof.

#NotMe Day June 1, 2019

Women across the country will unite to show they are “empowered self-protectors” and refuse to be victims.

#NotMeLUGOFF, SC – Sandhill Shooting Sports and the Kershaw County chapter of The Well Armed Woman (TWAW) Shooting Chapters invites women to head to a local shooting range on Saturday, June 1, 2019, for #NotMe Day. Together they will stand in solidarity with sister self-protectors and show the world they refuse to be a victim or to say #NeverAgain to ever being a victim again. Each participant will fire three rounds to symbolize: I am empowered, I am prepared, I will not be a victim.

“Women are tired of being the prey of violent criminals and are doing what it takes to protect themselves and their loved ones,” shares Carrie Lightfoot, #NotMe Day Organizer and founder of The Well Armed Woman Shooting Chapters. “#NotMe Day is an opportunity for all women to join together and show the world that women refuse to be forever bound to the unequal battlefield of violence,” Lightfoot continued.

Women are asked to wear the color purple, head to a local range and fire their symbolic rounds at any time during the day on June 1st. Participants are encouraged to share their photos on all social media platforms with the hashtag #NotMe and include #NeverAgain if they have been victims of violence in the past.

Sandhill Shooting Sports, the host range for the Kershaw County TWAW chapter is a woman-owned shooting range in Lugoff and will have a complimentary target available for women who would like to participate in #NotMe Day.

This event was inspired by a passionate speech given by Susan LaPierre, Co-Chair of NRA Women’s Leadership Forum and is a wonderful opportunity for all women to stand united as competent and courageous self-protectors.

Shooters should arrive to begin the check-in process no later than 4:15/5:15 and must be signed in and on the shooting line no later than 4:30/5:30.
